MERITS REVIEWAustralian legislation allows for the merits review of certain primary migration decisions, including decisions to refuse to grant visas.
Such reviews are generally undertaken by the Migration Review Tribunal (MRT), the Administrative Appeals Tribunal (AAT), the Refugee Review Tribunal (RRT) or the Immigration Assessment Authority (IAA).
Fragomen Australia’s Litigation and Review Team is highly active in the merits review space, regularly representing clients before merits review bodies.
As a member of the MRT-RRT Community Liaison Network, Fragomen is able to raise client issues directly with senior members of the MRT and the RRT including the principal member. Fragomen is similarly able to make representations to the AAT when it attends the AAT’s migration jurisdiction meetings.
