Canada: New Rules for Cancelling Temporary Resident Documents

Immigration, Refugees and Citizenship Canada (IRCC) has updated the Immigration and Refugee Protection Regulations to enhance the ability of immigration and border services officers to cancel temporary resident documents when necessary. Under the new regulations, effective immediately, officers now have explicit authority to cancel electronic travel authorizations (eTAs) and temporary resident visas (TRVs) if an individual becomes inadmissible due to a change in their status or circumstances; fails to demonstrate they will leave Canada by the end of their authorized period of stay; or if their document is lost, stolen, destroyed or abandoned. Additionally, officers can cancel TRVs, eTAs, work permits, and study permits if the holder becomes a permanent resident, is deceased, or received the document due to an administrative error. Before these changes, there was no direct regulatory framework outlining specific grounds for cancellation, and officers’ ability to revoke issued documents was less clearly defined. According to IRCC, these amendments aim to bolster the integrity of Canada’s temporary residence programs and enhance border security.
