A new Pay Limit Scheme is expected to be implemented on April 1, 2023 for highly-skilled foreign nationals to work and reside in Denmark for up to four years. The new scheme has a lower minimum salary level of DKK 31,250 per month as compared to the current Pay Limit Scheme which has a minimum salary level of DKK 38,750 per month. Despite the lower requirement, the foreign national’s position must still correspond to Danish standards, including having a similar salary to others in the same position, and the foreign national must have the necessary educational requirements and relevant years of work experience for the DISCO-code category. Further, the new Pay Limit Scheme will require employers to show that the job has been posted on Jobnet and the EURES-portal for at least two weeks prior to submission, which is not required under the current Pay Limit Scheme. In order to go into effect, the new Pay Limit Scheme still has to be approved by the Danish Parliament by March 23, 2023. Fragomen will report on updates when they are available.
