Government Sharply Increases Worksite Inspections

Kenyan officials continue to ramp up their immigration enforcement efforts with the Department of Immigration Services (DIS) substantially increasing the number of unannounced worksite inspections to companies that employ foreign nationals.
The DIS uses the worksite visits to identify foreign nationals who may be performing work without the appropriate authorization. The foreign nationals may be in visitor status or without lawful immigration status. Reports indicate that DIS officials have confiscated passports from non-compliant foreign nationals and, in some cases, arrested them.
What This Means for Employers and Foreign Nationals
Companies should ensure that foreign nationals visiting Kenyan worksites have proper authorization. Business visitors should limit their activities to only those that are allowable with a visitor visa, such as attending meetings or conferences and performing plant visits, and should carry with them a copy of the visa invitation letter as additional evidence of their lawful immigration status.
