Luxembourg: Relaxed Documentary Requirements for Posted Worker Notifications but New Requirements for International Transport Sector

Luxembourg’s posted worker notification platform has been changed to align with amendments to the labor code. Specifically, documents that are no longer required for a posted worker notification include: certain employee information (including the professional qualifications and job title in their home country) and certain employee documentation (including a medical certificate and professional qualifications/diploma). Further, the only documentation that now needs to be retained for the duration of the secondment are pay slips, time sheets and proof of payment; however, this documentation can now be stored at the place of work of the employee posted in Luxembourg or in any place accessible to this person so that it can be shared with the Labor and Mines Inspectorate if requested in case of inspection. Previously, this documentation had to be stored online. Further, workers and self-employed people in the international transport sector for passengers and goods are now subject to posted worker notifications (previously, they were exempt), and are required to submit a notification via a dedicated form in the Internal Market Information System.
