
Effective immediately, employers canceling the foreign national employee’s Work Permit are now required to notify the Registrar by filing a cancelation notification within seven calendar days from the last official work date. Although this cancelation notification requirement was previously in effect, it is now mandatory, and noncompliance will subject the employer to fines of up to THB 100,000 (approximately USD 2,940).
The period of notification is counted in calendar days, which, in effect, means that cancelation notification should be filed within five business days after the last working day.
Long-Term Visa Cancelation Process Unaffected
This change does not affect the process for cancelation of long-term visas. Foreign nationals and their dependents are still required to cancel their visas before the foreign national’s last official work date and before leaving Thailand.
What This Means for Employers and Foreign Nationals
Employers should ensure compliance with this additional step in the process when planning their foreign national employees’ exit from Thailand. Failure to comply with the notification requirement can result in significant monetary penalties.
