Poland: Legislative Changes Delayed

As an update, draft legislation on the employment of foreign nationals that was announced in July 2022 is still with the government for drafting and has not yet been passed to Polish parliament, which was expected to occur in September 2022. Changes to the initially announced measures are therefore likely and it is not certain whether the Q4 2022 adoption date can still be met. As a reminder, the draft legislation is expected to digitalize the Work Permit and Special Permission application processes; replace labour market testing with adjusted salary requirements for foreign workers; require foreign workers to receive at least the average salary for the position and industry; and prevent Work Permit issuance for part-time employment for less than 50% of permitted working hours.
