As of January 1, 2023, employers seeking to send foreign nationals to Slovakia under an Intracompany Transferee (ICT) Permit must submit a notification of the vacant position to the Labor Office, after which the Labour Office must approve the position to be filled by a foreign national. Previously, employers of ICT Permit applicants were not required to submit such a notification as part of the application process. It is not clear how this new step will impact the application process or if the employer must conduct a full labor market test after submitting the notification. Affected applicants and their employers should contact their immigration professional for case-by-case guidance.
