Vietnam: New Penalties for Mandatory Work Notification Violations Forthcoming

Effective September 10, 2026, the Vietnamese government will introduce updated administrative penalties for labor-related violations. While penalties for most work permit and foreign labor violations will remain broadly unchanged, the updated policy establishes new penalties for employers that fail to submit, or submit late, mandatory work notifications. These include notifications concerning employees working at multiple locations, work permit or work permit exemption certificate (WP/WPEC) cancellations, and other reporting obligations prescribed by the labor authorities. Individuals who employ foreign workers may face fines ranging from VND 1 million to VND 3 million for reporting violations. Fines for organizations are generally double those applicable to individuals, ranging from VND 2 million to VND 6 million. The decree also introduces specific penalties for using forged or altered documents to obtain a WP/WPEC. 

The new provisions reflect the authorities’ increasing focus on post-approval compliance. Employers should ensure that foreign worker reports are accurate and filed within the applicable deadlines; WP/WPEC cancellation requirements are completed promptly; and all supporting documents are authentic, properly legalized where required, and consistent with the employee’s actual work arrangements.
