A propósito de la pandemia declarada por el nuevo Coronavirus (COVID-19), el Gobierno Colombiano ha tomado múltiples medidas para mitigar el riesgo de propagación del virus y su impacto a la población y la economía colombiana.
 
A continuación, estas son algunas de las medidas relevantes tomadas por las autoridades colombianas en materia migratoria:
 
1. Mediante Decreto 457 de 2020, el Gobierno colombiano ordenó el aislamiento preventivo obligatorio de todos los habitantes de la República de Colombia a partir del 25 de marzo de 2020 hasta el 13 de abril de 2020, limitando así totalmente la libre circulación de las personas y vehículos en el territorio nacional, salvo 34 excepciones dispuestas en el mismo Decreto y relacionadas con garantizar el derecho a la vida, a la salud y supervivencia.
 
2. Mediante Decreto 439 de 2020, el Gobierno Colombiano suspendió, por el termino de 30 días calendario, el desembarque con fines de ingreso o conexión en territorio colombiano de pasajeros procedentes del exterior por vía aérea.
Únicamente se permitirá el ingreso de pasajeros o conexión en territorio colombiano, en caso de emergencia humanitaria, caso fortuito o fuerza mayor, previa autorización de Migración Colombia y la Aeronáutica Civil.
La única excepción aplica para los tripulantes, personal técnico y directivo y acompañantes a la carga de empresas de carga aérea.
 
3. Por su parte, Migración Colombia, mediante la Resolución 918 de 2020, ha dispuesto las siguientes medidas:
 
  • Suspensión de los términos de vigencia de los salvoconductos de permanencia hasta el 30 de mayo. Los salvoconductos a los cuales les aplica esta medida son: (i) aquellos obtenidos por libertad condicional u orden de autoridad competente; (ii) para resolver situación administrativa; (iii) por criterios discrecionales relacionados con derechos humanos y derechos fundamentales de sus solicitantes; y (iv) para aquellos extranjeros nacidos en Colombia.
    • Esta medida no aplica para aquellos salvoconductos de permanencia para solicitar y/o cambiar visas y de reconocimiento de la condición de refugiado.
  • Otorgar oportunidad de enmienda o abstenerse de iniciar actuación administrativa a los extranjeros que con ocasión del aislamiento preventivo ordenado por el Gobierno Nacional con ocasión de la propagación del COVID-19 no pudieron adelantar dentro de los términos legales, el registro de la visa y/o la solicitud de la cédula de extranjería.
  • Se suspende la contabilización del tiempo de ausencia para la cancelación del Permiso Especial de Permanencia (PEP) hasta el 30 de mayo de 2020 o hasta cuando se cumpla el termino establecido por el Gobierno nacional para la emergencia sanitaria.
  • Se suspende el termino de permanencia en el territorio colombiano, a los extranjeros a los que se les haya otorgado un Permiso de Ingreso y Permanencia tipo POA, hasta el 30 de mayo de 2020 o hasta cuando se cumpla el termino establecido por el Gobierno Nacional para la emergencia sanitaria.
 
4. El Ministerio de Relaciones Exteriores ha suspendido la atención al público desde el 24 de marzo de 2020, hasta el 13 de abril de 2020.
 
5. Las solicitudes de visa presentadas en los consulados no serán admitidas, independientemente de su clase o categoría.
 
Las medidas adoptadas por el Gobierno Nacional tienen la finalidad de conjurar los efectos de la crisis económica y social generada por la pandemia del nuevo Coronavirus COVID-19 mediante el fortalecimiento de acciones dirigidas a la protección de la salud de los habitantes del territorio colombiano y la prevención del impacto negativo en la economía.
 
La propagación de la enfermedad principalmente se ha relacionado de manera directa con los movimientos migratorios en todo el mundo; en efecto, a futuro las medidas en materia migratoria serán de carácter restrictivo, mientras no haya avances científicos certeros para el control y erradicación del COVID-19 a nivel mundial.
 
Adicionalmente, considero que muy probablemente en el mediano plazo vendrán nuevas restricciones que tendrán como objetivo controlar el flujo de migrantes entre naciones, y, posiblemente se implementarán estrictos requisitos para la obtención de visas y permisos, tales como, certificaciones de seguros médicos y afiliaciones al sistema de seguridad de social, verificación o seguimientos a movimientos migratorios previos, e incluso exámenes médicos que certifiquen la salud del extranjero, además de asegurar su correcta cobertura ante cualquier eventualidad y así mitigar el impacto en el sistema de salud colombiano.
