With more states enacting wage transparency laws requiring employers to provide salary ranges on job postings, Partners Sophia Goring-Piard and Da’Niel Rowan explain the impact on two immigration processes:
- The Labor Conditions Application (LCA) requires employers to provide notice of the filing at the place of employment. Under the new laws, employers will need to include a wage range on each job posting notices.
- The employment-based permanent residency applications, PERM process, requires a sponsoring company to test the job market with advertisements and job postings. If salary information is included, as required by law in five states, the DOL requires that the posted range does not contain a wage rate lower than DOL’s prevailing wage rate.
