Labour Market Impact Assessment- Exempt Category of Emergency Repair Workers Expanded

Effective immediately, the Labour Market Impact Assessment (LMIA)-exempt work permit category for emergency repair personnel, C13, has been expanded to include personnel repairing industrial or commercial equipment that is no longer under warranty or that is not covered by an after-sales or lease agreement.
Background
Prior to May 21, 2015, in order to obtain work authorization for individuals who possessed the specialized knowledge required to repair industrial machinery/equipment not covered under an after sales/lease agreement or warranty, employers were subject to the LMIA test, which included a government fee of CAD$1,000 per applicant.
Application Process
Employers applying for the LMIA exemption must complete the IMM5802-Offer of Employment form and to pay a fee of $230 CAD.
What This Means for Employers
Employers should benefit from the elimination of the need to apply for an LMIA to support the work permit application of an employee performing repair activities for industrial or commercial equipment.
