Netherlands: Non-European Parents of Dutch Children Can Obtain an EU-Long Term Residence Permit Under Certain Conditions

The Court of Justice of the EU ruled that non-European parents of minor Dutch children (due to the name of the case that was before the Court of Justice, these parents are often referred to as “Chavez” parents) can no longer be denied EU-Long Term residence permit on the grounds that their Chavez right of residence is temporary in nature. According to Immigration & Naturalisation Service (IND), the Chavez right of residence could, however, still be considered temporary for a Dutch citizenship application.
