United States: DHS Announces End of Temporary Protected Status for Nepal

A closer look
Department of Homeland Security (DHS) Secretary Kristi Noem announced the termination of Temporary Protected Status (TPS) for Nepal. According to the Federal Register notice, TPS for Nepal expires on June 24, 2025, and beneficiaries will be granted a 60-day transition period, through 11:59 pm local time on August 5, 2025.
Nepal was initially designated for TPS on June 24, 2015. This designation was followed by several extensions, some of which were issued to comply with ongoing litigation after the first Trump Administration took action to terminate the designation in 2018. On June 21, 2023, the Biden-era DHS published a Federal Register notice rescinding the prior Trump administration’s termination of Nepal TPS and extending the designation through June 24, 2025.
According to Secretary Noem, the conditions that led to the initial designation of TPS for Nepal are no longer met. Advocacy organizations have filed recent lawsuits challenging DHS’s termination of Afghanistan and Cameroon TPS designations, and the termination for Nepal could prompt similar court challenges.
Employment authorization during 60-day transition period
DHS recognizes that Nepal TPS beneficiaries continue to be employment-authorized during the 60-day transition period. Accordingly, through the Federal Register notice, DHS automatically extends the validity of certain EADs previously issued under the TPS designation of Nepal through August 5, 2025.
As proof of continued employment authorization through August 5, 2025, TPS beneficiaries can present an EAD that has the notation A-12 or C-19 under Category and a “Card Expires” date of June 24, 2018, June 24, 2019, March 24, 2020, January 4, 2021, October 4, 2021, December 31, 2022, June 30, 2024, and June 24, 2025.
Employers will need to reverify the employment eligibility of affected employees, and update their records to indicate the new expiration date of August 5, 2025.
