United States: Further Brief Extensions of TPS Employment Authorization for South Sudan and Ethiopia

The issue
U.S. Citizenship and Immigration Services (USCIS) is again briefly extending the validity of employment authorization documents (EADs) issued under the Temporary Protected Status (TPS) designations listed below as follows:
- South Sudan through August 10, 2026; and
- Ethiopia through August 19, 2026.
The previous extension of EAD validity for these countries remained valid through August 6.
USCIS continues to briefly extend TPS EADs for several countries following the June 25 U.S. Supreme Court decision allowing the Trump Administration to proceed with termination of the TPS designations for Haiti and Syria. The Supreme Court decision is affecting the outcome of all ongoing TPS litigation, including for South Sudan (African Communities Together et al. v. Noem et al., No. 25-cv-13939-PBS (D. Mass.)) and Ethiopia (African Communities Together et al. v. Noem et al., No. 26-cv-10278-BEM (D. Mass.)).
Which EADs are affected by the extension?
- South Sudan TPS EADs that benefit from today’s automatic extension through August 10, 2026 are those with an original expiration date of Nov. 3, 2023, May 3, 2025, or Nov. 3, 2025.
- Ethiopia TPS EADs that benefit from today’s automatic extension through August 19, 2026 are those with an original expiration date of June 12, 2024 or Dec. 12, 2025.
