At a glance

  • The EB-2 India Final Action date will advance by a full year, to September 1, 2014.
  • The previously current EB-5 China Unreserved Non-Regional Center (C5 and T5) categories will be subject to a Final Action Date of November 22, 2015 and a Date for Filing of December 15, 2015.
  • EB-1 will remain current for all countries. EB-2 and EB-3 Professional and Skilled Worker will remain current for all countries except India and China.

A closer look 

According to the State Department’s June Visa Bulletin, Final Action cutoff dates for issuance of an immigrant visa will be as follows: 

  • EB-1: All countries, including India and China, will remain current.
  • EB-2: India will advance by one year, to September 1, 2014, and China will remain at March 1, 2019. All other countries will remain current.
  • EB-3 Professionals and Skilled Workers: EB-3 India and EB-3 China will remain unchanged from the previous month, at January 15, 2012 and March 22, 2018, respectively. All other countries will remain current.
  • EB-3 Other Workers: This category was previously current for all countries except India and China. However, to avoid exceeding the annual numerical limits, the Department of State is establishing a worldwide cutoff date of May 8, 2019 for this category. India and China will remain unchanged at January 15, 2012 and June 1, 2012, respectively.
  • EB-5: Due to current demand levels, the Department of State is establishing a Final Action cutoff date of November 22, 2015 for the EB-5 China Unreserved Non-Regional Center (C5 and T5) categories. This same Final Action date will also continue to apply to EB-5 China Unreserved Regional Center (I5 and R5) case types. EB-5 Final Action dates will remain current for all other countries and for all EB-5 “Set-Aside” categories (Rural, High Unemployment, and Infrastructure).

In the coming days, USCIS is expected to announce on its own Visa Bulletin web page the cutoff dates for acceptance of adjustment of status applications next month. That announcement will clarify whether USCIS will accept adjustment of status applications based on the Final Action dates chart, or on the Dates for Filing chart. The Dates for Filing chart in the June Visa Bulletin remains the same as last month, with the exception of the EB-5 China Unreserved Non-Regional Center (C5 and T5) categories, which will change from current to a Date for Filing of December 15, 2015, matching the Date for Filing for EB-5 China Unreserved Regional Center (I5 and R5) categories.
