At a glance

  • In June, the Final Action Date for EB-2 India will retrogress by more than 10 months, while the EB-1 India Final Action Date will retrogress by three and a half months.
  • The Final Action Dates for EB-3 Professionals and Skilled Workers will advance by six weeks for China and by one month for India.

A closer look

According to the State Department’s June Visa Bulletin, Final Action cutoff dates for issuance of an immigrant visa or approval of an adjustment of status application will be as follows:

  • EB-1: China will remain at April 1, 2023. India will retrogress by three and a half months to December 15, 2022.  All other countries will continue to be current.
  • EB-2: China will remain at September 1, 2021. India will retrogress by more than 10 months to September 1, 2013. All other countries will continue to be current.
  • EB-3 Professionals and Skilled Workers: China will advance by six weeks to August 1, 2021. India will advance by one month to December 15, 2013. The Philippines will remain at August 1, 2023, and all other countries will remain at June 1, 2024.
  • EB-5: For the EB-5 Unreserved categories, China will remain at September 22, 2016, and India will remain at May 1, 2022. All other countries will remain current. The EB-5 set-aside categories (Rural, High Unemployment, and Infrastructure) will also remain current.

The June Visa Bulletin employment-based Dates for Filing chart will remain the same for all countries and categories. In the coming days, USCIS will announce on its own Visa Bulletin web page whether the agency will accept adjustment of status applications based on the Visa Bulletin Final Action Dates chart or the Dates for Filing chart in June.

State Department comments on availability of immigrant visas

The June Visa Bulletin acknowledges that, as warned in last month’s Visa Bulletin, it has been necessary to retrogress the June Final Action Dates for certain employment-based categories due to increased demand and immigrant visa usage. As noted above, EB-1 and EB-2 India will retrogress in June, and the State Department warns that further retrogressions in these categories, or making the categories unavailable, may be necessary before the fiscal year ends on September 30, 2026.

In the June Bulletin, the State Department also says that demand and increased immigrant visa number use may make it necessary to retrogress or make unavailable the following other categories in the coming months:

  • EB-2 China;
  • EB-3 Philippines; and
  • EB-5 India.

The June Bulletin also issues a general warning that some visa categories may become “unavailable” prior to the end of the fiscal year.
