从2016年10月起,中国部分试点城市(包括北京、深圳和广州)已经率先开始实施外国人来华工作许可新政,2017年4月1日起新政将会在全国范围内统一实施。

 

关于新政

新政旨在统一外国人来华工作许可申请的流程,更好地吸引全球高层次人才来华,控制一般层次外籍劳工,以及将外籍劳工和中国本地市场需求相匹配。

新政参照外国人来华工作分类标准(含计点积分制)将外籍人士分为三类:

·  A类 - 外国高端人才;

·  B类 - 外国专业人才;

·  C类 - 参加季节性或临时性工作的外国普通人员。

 

香港、澳门和台湾居民将不受新政影响。

为了更好地帮助各地区政府实施新政,中央发布了大纲作为参考。但是,各试行地区落实新政的速度各不相同,具体实施程度也有差别。

如今,我们已经迎来了六个月新政试运营的收尾阶段。全国范围内都已经准备从2017年4月1日起正式在各类外国人工作许可申请中启用新政策。

 

新政的影响

新政将会影响申请要求、流程以及申请时间,具体包括:

·  将外籍人士分为三种类型的工作人员;

·  将全国的申请要求及流程规范化;

·  合并专家证与就业证为外国人工作许可证;

·  将全国所有类型的申请信息都并入一个集中的网络系统及数据库;

·  申请流程更为复杂,申请时间延长;以及

·  提升数据透明度和对外籍员工的合规要求;

 

新政的主要目的是为了吸引那些可以帮助中国转型为知识与技术型经济体的外籍人才,将其他外籍劳工与各地区市场要求相匹配,同时限制低层次的外籍人员,保护中国本地就业市场。

新政将帮助中国政府通过全新的线上系统,更好地管控外籍劳工,并且实现中国范围内的数据共享和数据透明度。 

出于这一目的,外籍员工类别不同,申请流程也不同。B类及C类外国人的申请时间预计约为5-7个月或者更长;与之前的就业证申请流程相比,目前B类和C类外国人将会面临更为复杂的流程。与此同时,外国高端人才(A类外国人)将在全国各地享受更快的申请流程,平均申请时间将缩短至2-3个月。

申请材料方面也是如此。A类外国人的申请材料将会少于B类与C类外国人。

新政运作的结果就是那些“高精尖缺”的外国人能够比其他外国人更快速地入境中国。而那些不符合紧缺人才标准的外籍人士进入中国要花费更长时间,流程也会更复杂。 

 

对雇主的影响 

新政将会拓展在华外籍劳工的范围,为寻求高技能员工的企业扩大了人才库。

在新政下,雇主应当首先仔细审核候选人的个人背景和专业背景,对候选人适合的类型进行内部评估,以预判就业证申请的相关申请时间。

所有未来的申请都要通过统一的在线系统进行,不同政府机构会通过该系统分享在华外籍员工的信息和数据。因此,公司必须要确保其外籍员工合规合法,才能够保证公司在政府面前保持良好信誉,这一点非常重要。

 

新政的展望

虽然新政的大框架,比如申请资格、申请要求和支持文件等已经明确,但是从试行阶段的经验来看,新政的具体落地细节在现阶段尚不明晰。但是有一件事情却非常明确,那就是随着4月1日日渐推进,还没有让相关人员做好准备的公司应该尽快培训相关人员,从而帮助公司合理管理新招聘外籍员工以及现有外籍员工的期望值。

费戈曼预计这段不确定时期将会持续2017年全年,甚至可能延续至2018年,因为每个地方都会根据自己对新政的解读、按照自己的方式来实施调整和新政落地。因此,我们希望公司能够与费戈曼保持良好畅通的沟通,保证在未来能够了解相关最新情况。
