Am 30. Januar 2019 schlug die Europäische Kommission eine Reihe von Notfallmaßnahmen für den Fall eines No-Deal Brexit vor. Diese Maßnahmen werden von der EU einseitig angenommen werden.

Eine Reihe von Maßnahmen betrifft den Schutz der Rechte der sozialen Sicherheit der Bürger des Vereinigten Königreichs und der EU-Bürger:

„Die Kommission hat stets deutlich gemacht, dass ihr die Rechte der EU-Bürgerinnen und Bürger im Vereinigten Königreich und die der Staatsangehörigen des Vereinigten Königreichs in der EU sehr wichtig sind. Sie sollten nicht den Preis für den Brexit zahlen. Mit dem heute vorgelegten Vorschlag soll sichergestellt werden, dass bei einem Austritt ohne Abkommen die Ansprüche der Personen, die ihr Recht auf Freizügigkeit vor dem Austritt des Vereinigten Königreichs ausgeübt haben, gewahrt werden. Dazu gehören vor dem Austritt des Vereinigten Königreichs aufgelaufene Versicherungs-, (auch als Selbstständiger erworbene) Erwerbstätigkeits- oder Aufenthaltszeiten. Wenn beispielsweise ein Bürger aus den übrigen 27 Mitgliedstaaten vor dem Brexit 10 Jahre lang im Vereinigten Königreich gearbeitet hat, sollte dieser Zeitraum bei der Berechnung seiner Rentenansprüche von den zuständigen Behörden des Mitgliedstaats, in dem er in den Ruhestand geht, berücksichtigt werden.

Mit dem Verordnungsentwurf wird sichergestellt, dass die Mitgliedstaaten auch künftig die Grundprinzipien der Koordinierung der Systeme der sozialen Sicherheit in der EU (Gleichbehandlung, Gleichstellung von Leistungen und Zusammenrechnung von Versicherungszeiten) anwenden. Der vorliegende Vorschlag kann jedoch in keiner Weise die erheblichen Vorteile des am 14. November vereinbarten Austrittsabkommens nachbilden. Er gilt weder für nach dem 29. März 2019 erworbene Rechte, noch deckt er die Exportierbarkeit von Geldleistungen, die fortlaufende Bereitstellung von Sachleistungen bei Krankheit und die Bestimmungen zu den anwendbaren Rechtsvorschriften ab.“

Die Europäische Kommission unterscheidet das No-Deal-Szenario klar vom Deal-Szenario, wobei bei einem Deal-Szenario alle Grundprinzipien der EU-Verordnungen zur Koordinierung der Systeme der sozialen Sicherheit während der Übergangszeit (bis zum 31. Dezember 2020) weiterhin gelten würden. 

Was folgt

Die Europäische Kommission wird mit dem Europäischen Parlament und dem Rat der EU zusammenarbeiten, um eine Verordnung hinsichtlich der vorgeschlagenen No-Deal Szenario Notfallmaßnahmen zu erarbeiten, die im Falle eines No-Deal-Brexit ab 30. März 2019 in Kraft treten sollten.
