Am 9. Februar 2014 haben das Volk und die Stände die Volksinitiative «Gegen Masseneinwanderung» mit 50,3% angenommen. Wie wird die Initiative nun, 4 Jahre nach deren Annahme, durchgesetzt?

Mit Annahme der Initiative im Februar 2014 wurde der Bundesrat und das Parlament verpflichtet, innert drei Jahren ein neues Zuwanderungssystem bezüglich EU Bürger einzuführen, welches ein Instrument zur Steuerung der Zuwanderung aus den Ländern der Europäischen Union ermöglicht, unter Berücksichtigung des gesamtwirtschaftlichen Interesses und mit einem Inländervorrang. Zusätzlich musste beachtet werden, dass der neue Artikel in der Bundesverfassung nicht dem Freizügigkeitsabkommen (FZA) mit der Europäischen Union (EU) und den bilateralen Verträgen widerspricht.

Bereits am 4. März 2016 konnten mehrere Gesetzesentwürfe dem Parlament vorgelegt werden. Zusätzlich wurde vom Bundesrat festgehalten, dass die Verfassungsbestimmungen zur Zuwanderung zwar umgesetzt würden, man aber auch eine einvernehmliche Lösung mit der Europäischen Union anstrebe. Aus diesem Grund führten das Eidgenössische Justizdepartement und das Eidgenössische Departement für äussere Angelegenheiten zusammen mit Vertretern der Europäischen Union bis in den Sommer 2016 intensive Beratungen durch. Die Annahme des Brexit-Referendums stellte jedoch schnell klar, dass keine gemeinsame Lösung mit der Europäischen Union gefunden werden kann.

Nichtsdestotrotz wurde am 21. September 2016 vom Nationalrat der sogenannte «Inländervorrang light» beschlossen und später vom Ständerat bestätigt. Die Umsetzung des Inländervorrang light wurde am 8. Dezember 2017 verabschiedet.

Konkret wird das neue Gesetz wie folgt umgesetzt: Es wird eine Stellenmeldepflicht in jenen Berufsarten eingeführt, in denen die Arbeitslosigkeit einen bestimmten Prozentsatz überschreitet. Ab dem 1. Juli 2018 gilt daher ein Schwellenwert von 8% und ab dem 1. Januar 2020 ein Schwellenwert von 5%. Das SECO (Staatssekretariat für Wirtschaft) hat eine entsprechende Liste am 30. April 2018 veröffentlicht.

Was heisst das für den Arbeitgeber?

Arbeitgeber müssen als Folge der neuen Regelung alle Stellen in Berufsarten, in denen die Arbeitslosenquote diesen Schwellenwert erreicht oder übersteigt zwingend dem Regionalen Arbeitsvermittlungszentrum (RAV) melden und auf deren Homepage für mindestens fünf Tage vor der eigentlichen Veröffentlichung publizieren. Das RAV hat dem Arbeitgeber innert drei Tagen geeignete Dossiers mitzuteilen. Der Arbeitgeber muss als Folge geeignete Stellensuchende zu einem Bewerbungsgespräch einladen oder mindestens eine Eignungsabklärung durchführen und dem RAV mitteilen, ob eine Anstellung erfolgt. Eine Absage an den Bewerber muss beim RAV nicht begründet werden.

Gibt es Ausnahmen?

Der Bund hat bei der Umsetzung der neuen Gesetzgebung auch Ausnahmen definiert. Wenn Stellen durch beim RAV Gemeldete besetzt werden, müssen Sie nicht gemeldet werden. Stellen müssen ausserdem nicht gemeldet werden, wenn:

  • Sie innerhalb eines Unternehmens mit Personen besetzt werden, die seit mindestens sechs Monaten angestellt sind;
  • Die Beschäftigung maximal 14 Tage dauert;
  • Personen angestellt werden, die mit Zeichnungsberechtigten im Unternehmen durch Ehe oder eingetragene Partnerschaft verbunden oder in gerader Linie oder bis zum ersten Grad in der Seitenlinie verwandt oder verschwägert sind.
