EU sozialversicherungsrechtliche Koordinationsregeln sollen weiterhin Anwendbarkeit finden, auch wenn es kein Brexit ‚Deal‘ gibt

Um die Freizügigkeit von Personen innerhalb der Europäischen Union weiterhin zu fördern und Doppelsozialversicherung und teure Verwaltungsverfahren zu vermeiden, gibt es geltende EU Sozialversicherungsrechtsvorschriften, die in allen Mitgliedstaaten greifen.
Gemäß den europäischen Vorschriften (Verordnung (EG) Nr. 883/2004 zur Koordinierung der Systeme der sozialen Sicherheit und der Durchführungsverordnung (EG) 987/2009) gilt, dass grenzüberschreitende Arbeitnehmer, die im Gebiet eines Mitgliedstaates abhängig beschäftigt sind, den Rechtsvorschriften dieses Staates unterliegen, auch dann wenn Arbeitnehmer kurzfristig (Geschäftsreise) oder längerfristig (z.B. Projektarbeit) in einen anderen Mitgliedstaat entsendet werden.
Von diesen Vorteilen profitieren derzeit alle EU Mitgliedstaaten und auch im Brexit-Abkommen wurde dies abgesichert. Um weiterhin von diesen Vorteilen zu profitieren, auch für den Fall das Brexit im No-Deal mündet, hat die britische Regierung den Entwurf für die zukünftige Anwendbarkeit der sozialversicherungsrechtlichen Koordinationsregeln seitens Grossbritannien (lokale Gesetzgebung) veröffentlicht.
Derzeit wirken die sozialversicherungsrechtlichen Koordinationsregeln in der EU erfolgreich dank gegenseitiger Kooperation und Anwendbarkeit der Vorschriften zwischen den Mitgliedstaaten. Das kann leider nicht garantiert werden, wenn Großbritannien die EU verlässt ohne sich auf einen Deal zu einigen. Die Intention der lokalen Gesetzgebung ist die Rechte der grenzüberschreitenden Arbeitnehmer weitestgehend zu wahren, auch im Falle eines No-Deals.
Der Entwurf sieht vor, dass das derzeitige sozialversicherungsrechtliche EU Regelwerk weitestgehend übernommen wird. Für Unternehmen bedeutet das, dass in diesem Rahmen keine Änderungen stattfinden werden sollten, es sei denn das Unterhaus widerspricht dem Entwurf. Selbst bei einer Zustimmung bleibt offen wie EU Mitgliedstaaten auf den Vorschlag, dass Großbritannien die EU Sozialversicherungsrechtsvorschriften im Kern auch im Falle eines No-Deals weiter anwenden möchte, reagieren werden.
