Flexibility Introduced for Certain Visa Guidelines

On October 17, 2014, Mexico implemented broad changes to its visa issuance rules. Our analysis of the changes has revealed that the most relevant amendments include extended validity time frames for scheduling post-work permit approval consular interviews and direct consular applications for certain business visitors. These changes and others will be implemented through sweeping revisions to the visa issuance rules.

- The period to schedule and attend an appointment for a consular interview has been increased from 15 business days from the date of work permit approval to 30 business days.
- The dependents of Temporary Resident Students are now eligible to request a temporary resident status through a Family Reunion Process. However, neither the principals nor their dependents will be eligible for permanent residence.
- The requisite amounts to prove economic solvency for certain types of non-remunerated visa categories have been reduced. The amounts depend on the type of visa applied for.
- Foreign citizens who are subject to international agreements related to global mobility (Instrumentos Jurídicos Internacionales de Movilidad de Personas) are eligible to request Temporary Residence Visas for non-remunerated activities at Mexican consular posts abroad. There are no clear guidelines that list the eligible international agreements at this time.
What This Means for Employers and Foreign Nationals
Foreign nationals will benefit from the increased flexibility of the amendments, which are meant to make working, living and studying in Mexico easier for foreign nationals.
