In a recent Forbes article, Partner Kevin Miner shares insight into a new approach by US Citizenship and Immigration Services (USCIS) to issue Requests for Evidence (RFEs) tied to “adverse information” in H-1B and employment-based green card petitions.
Unlike typical RFEs, these notices request residential addresses and biometrics without specifying what information triggered the request. As Kevin explains, the process deviates from the agency’s typical written information exchange and lacks clarity on how employers can respond effectively. With no public guidance from USCIS, questions remain about how these requests will be handled moving forward.
