Following the discontinuation of the COVID-19 I-9 document review policy on July 31, some employers have experienced difficulties in adapting to physical document review.
However, employers enrolled in the U.S. Department of Homeland Security's E-Verify program retain the ability to perform remote document reviews for employees hired on or after August 1, incorporating new procedures and an updated I-9 form.
There is also potential for smaller employers that are not enrolled with E-Verify to participate in a pilot program that would allow them to utilize remote document review for I-9 completion. More details regarding the pilot program will likely become available in October 2023.
