The Netherlands: Relaxed Rules for “Cooling-Off Period” for Intra-Corporate Transferees

Expected to begin July 1, 2023, Intra-Corporate Transferees (ICTs) who are transferred to the Netherlands for a period shorter than the maximum duration of their ICT permit (which can be for one or three years) will no longer be subject to a six-month “cooling off” period and can immediately apply for another ICT permit. Previously, they had to wait for the six-month period to expire before obtaining a new ICT permit. This change in law will allow foreign nationals to move more easily from other EU Member States to the Netherlands. The change in law came about as the State Secretary for Justice and Security found that the EU directive on ICTs was improperly transposed into Dutch law.
