For many individuals in the United States, open enrollment provides an opportunity to enroll in or change health insurance coverage. For J-1 exchange visitors, however, selecting a new health insurance plan can have immigration implications.
Lower-cost health insurance options may not satisfy US Department of State requirements for individuals in J-1 status. This is particularly important in light of a proposed Department of State rule that would make failure to maintain adequate health insurance a mandatory ground for termination of J-1 status.
If the proposed rule takes effect, J-1 exchange visitors will need to pay particularly close attention to their health insurance elections during open enrollment.
Individuals in J-1 status should carefully review Department of State requirements before selecting or changing health insurance coverage. Sponsors and host organizations should also consider reminding J-1 exchange visitors of these requirements as part of their open enrollment communications and implementing safeguards designed to prevent participants from selecting plans that do not meet applicable requirements.
