The US Citizenship and Immigration Services (USCIS) recently published a comprehensive proposed rule related to the H-1B visa program for skilled workers that could significantly modify the regulatory definition of a "specialty occupation.” Partner Kevin Miner spoke with SHRM about the proposal, and whether the language in the proposed rule still leaves a lot of uncertainty as to how USCIS adjudicators will evaluate H-1B petitions.
