在米日系企業でも、自社の社員を他社に派遣したり、取引先や顧客から社員を受け入れ一定期間就労させたりするケースは多くあると思います。自動車業界では、『ゲストエンジニア』という名称で、自動車メーカーに他社の技術者が派遣され、そこで仕事をするのは一般的と言われます。また、コンサルティング業界では、ITやシステム関連、ビジネスのコンサルタントが顧客会社に一定期間常駐し、仕事をする就業形態は一般的ですので、そのような社員を受け入れている在米日系企業も多いはずです。
 
ただ、そのようなエンジニアやコンサルタントが、H-1Bビザを持つ外国籍社員の場合、派遣する側そして受け入れる側双方に多くの移民法上の義務があること、またそれが政府による監査の対象になりかねないことをご存知でしょうか?このような法律上の義務や監査は以前から存在しましたが、最近新たな指針が出されさらに厳しくなっています。今月の移民法ダイジェストは、それを中心に解説します。
 
 
 
1.H-1Bビザ保持者を他社に派遣したり、皆さんの会社で受け入れる際の注意点 -労働省が、H-1B社員雇用者や受け入れ先会社に対し、Labor Condition Application の電子告知に関する新たな義務を課す
 

概要
 
労働省は、Labor Condition Application (LCA)の告知に関する新たなガイダンスを発表しました。H-1Bビザ社員を雇用する会社は、LCAの通知・告知義務への自社の履行プロセスやコンプライアンスを確認し、今回の新たなガイダンスへ対応するよう整備すべきでしょう

 
H-1Bビザ申請は、(1)労働省に対するLCA申請と(2)移民局に対するH-1Bビザ申請という2工程を経る必要があります。LCA申請は、H-1Bビザ申請の対象となるポジション名や給与額、勤務地などを開示する申請です。
 
H-1Bビザ社員を雇用する会社は、申請の過程で自社の他の社員に対し、H-1Bビザ申請を行う予定であることを告知(Posting)を通じて連絡し、社員はH-1B社員の雇用条件や職務などの情報を閲覧する権利があることや、同社員の雇用に際し会社側がルール違反をしたと疑われる場合は、労働省へ告訴する権利があることを通知する義務が法律で定められています。この通知義務は、H-1Bビザ社員が他の会社へ派遣され勤務する際には、派遣先会社の社員にも及びます。つまり、例えば皆さんの会社にコンサルティング会社のH-1Bビザ社員がプロジェクト対応の為に一定期間派遣され勤務する際は、そのコンサルティング会社が皆さんの会社の社員に対し、左記の通知をしなければならないということになります。
 
この告知義務は、H-1Bビザが誕生した1990年当初から存在するルールですが、今回の労働省のガイダンスはそれを格段に強化する方針と言えるでしょう。

今回労働省のWage and Hour Divisionが発表した新しいガイダンスは、H-1Bビザ社員を雇用する会社がLCAに関する通知・告知義務を強化することで、その義務を確実に履行することを意図したものです。新しいガイダンスでは、
 
  • 雇用者は、社内のLCA告知方法を精査する。
  • H-1Bビザ社員が他社へ派遣される場合でも、その会社における告知方法を精査する
  • 告知を電子通知によって行っている場合は、H-1Bビザ社員の雇用で影響を受ける米国籍社員が電子通知をいつでも閲覧・入手できるよう、次のようなあらゆる必要処置を講じ保証する
  • 自社及び派遣先会社の米国籍社員がLCAの内容を知っていること
  • 電子通知は、簡単にアクセスできること。電子通知がどこにあるか知らせていなかったり、わかり難い場所に保管してある場合は、コンプライアンス上不十分とする
  • 通知を閲覧する米国籍社員が、自分たちの勤務先に関連する電子通知がどれであるか、すぐわかるようにしておく

このガイダンスに違反した場合は、H-1Bビザ申請の禁止を含めた厳しい罰則が設けられています。

H-1Bビザ社員雇用者やH-1Bビザ社員を受け入れる側にとって、今回のガイダンスが持つ意味

労働省によるLCAの監査が増えている昨今、今回の新しいガイダンスがH-1Bビザ社員を雇用する企業だけでなく、外部から受け入れいている会社にとっても持つ意味は大きいでしょう。雇用者と受け入れる会社双方とも、通知・告知義務の履行に対しこれまで以上に注意する必要があります。特に、電池通知を通じ告知を行っている企業は、要注意です。

H-1B社員を雇用する会社は、自社のLCA告知プロセスをこの新しいガイダンスへどのように合わせていくか検討する必要があります。H-1B社員が顧客先やプロジェクトサイトなど、自社のオフィス以外に派遣されている場合且つ、電子通知を通じて告知義務へ対応をしている場合は、通知へのアクセスなどに関して新たな対応が必要になるでしょう。
 
更に、日系企業にとっては、今回のガイダンスが自社のH-1B社員の雇用や受け入れに関する移民法へのコンプライアンスを再確認する良い機会になるはずです。例えば、貴方の会社が定期的に外部からコンサルタントを受け入れ自社内で仕事をさせている場合、そしてその社員がH-1Bビザ社員であれば、今回の告知義務を負うだけではありません。当該コンサルタントのH-1Bビザ申請の為に、顧客からの求めに応じ、移民局に対しコンサルティング契約書を提出したり、皆さんの会社名でサポートレターを移民局に提出している可能性もあります。そのような資料を提出していれば、政府はその資料を基に皆さんの会社を調査することもできます。
 
よって、外部の会社から社員を受け入れる際にの対応を、社員の然るべき部署や立場の方が一元的に管理しているのか、社内のアカウンタビリティーが確立されているのか、上層部の誰も知らないところで担当者が自らの判断で勝手な対応をしていないか、などを確認し、会社としての対応方法や確認方法を確立することがますます重要になっています。H-1Bビザ社員を直接雇用していなくても、そのような社員を外部から受け入れているという理由で法律上の義務が発生し、場合によっては監査や調査の対象になりえることに注意してください。
 
トランプ政権の合法移民・就労ビザに対する方針厳格化の背景には、合法移民や就労ビザ保持者が、アメリカ人の職の機会を奪っているのではないかという疑心があります。外国人に職の機会を奪われ解雇されたするアメリカ人の訴えに対しては、雇用差別という理由で政府が企業を訴える訴訟も増えています。今回の労働省のガイダンスは、このような背景からもとても重要なガイダンスと言えます。

 
 
2.       移民局は、一部のH-1B発給枠申請への特急審査対応を、5月20日から開始することを発表
 

概要
移民局は、在留資格変更要請(Change of Status Request)を伴う2020年度発給枠対象のH-1Bビザ申請への特急審査対応を、5月20日から開始することを発表しました。但し、それは申請の際に最初から特急審査の要請を行っていることが条件です。それ以外のH-1B発給枠申請に対する特急審査対応は、早くても6月からの予定です。
また、5月20日から6月3日迄、移民局は受取人払いのFedEXやUPSをはじめとする配送会社の発送ラベルを使用した認可証他の通知の送付は行いません。


2020年度発給枠のH-1Bビザ申請に対する特急審査の適用は、次のとおり段階を経て適用されていきますのでご注意ください。
 
  • 在留資格変更要請を伴う申請
4月1日から5日までの申請期間内に、特急審査要請を伴って提出されたH-1Bビザ申請に対しては、5月20日から特急審査要請に基づく審査が開始されます。
  • 通常審査から特急審査への『格上げ』要請
在留資格変更を要請を伴う申請で、当初は特急審査の要請を行っていないH-1Bビザ申請を、後から特急審査へ変更したい場合は、5月20日まで格上げ要請の提出を待つ必要があります。
  • その他のH-1Bビザ発給枠申請の、特急審査への格上げ
    在留資格の変更要請を伴わない発給枠対象のH-1Bビザ申請は、通常審査として意味局へ提出されます。こららの申請を、後から特急審査へ格上げする場合は、少なくとも2019年6月まで待つ必要があります。

受取人払いの発送ラベルを使用した認可証他の通知の送付
 
移民局からのレシートや認可証を一日も早く受領したい場合、申請書類にFedExやUPSなどの着払い郵送ラベルを同封しておくと、移民局はこのラベルを使用して書類を発送してくれます。しかし、移民局は5月20日から6月3日までの間、この対応を保留し、着払いラベルでの郵送を行わないことを発表しました。代わりに、認可証や追加書類要請などの通知は、通常の郵送で発送するということです。よって、移民局からの書類入手には、暫く時間を要することになりそうです。尚、この方針は、在留資格変更要請を伴う特急審査のH-1Bビザ発給枠対象申請だけです。
