Associated Press: What Is the Highly Coveted H-1B Visa? Trump Administration Moves Put Attention on the Program

In speaking with The Associated Press, Partner Kevin Miner explains that American Immigration Lawyers Association (AILA) members have recently received letters requesting biometrics from individuals applying for or renewing H-1B and I-140 visas.
He notes that these requests are unusual, as biometrics are not typically required for these case types, and the government’s requests are often more specific. Kevin points out that changes of this nature are generally announced through a notice-and-comment process, which has not happened in this case. He describes the approach as different from the usual back-and-forth process immigration attorneys are used to seeing, adding that people are increasingly concerned additional, unexpected enforcement actions might follow for those on employment-related visas.
