Prospective EB-5 applicants should be aware of several important program considerations and upcoming deadlines as they evaluate the EB-5 Immigrant Investor Program as a pathway to permanent residence in the United States.

In this episode of The Immigration Conversation, Partner Chad Blocker, Senior Counsel Mitchell Wexler and Associate Alex Kim discuss key elements of the EB-5 process, including documenting the source and path of investment funds, selecting a project, understanding concurrent filing, preparing for possible retrogression and navigating the process from the initial investor petition through removal of conditions.

The conversation also highlights two important upcoming deadlines: the September 30, 2026 grandfathering deadline, which may help protect certain investors if the program is not renewed, and the January 1 investment amount increase, which is expected to raise the minimum investment amount from $800,000 to more than $900,000.

The speakers also discuss recent guidance related to adjustment of status and why EB-5 investors may be well positioned to demonstrate positive discretionary factors, including investment in the United States and job creation.
