South Africa remains open to international talent, investment and business, but foreign nationals and employers must understand the country’s immigration pathways and comply with the conditions attached to each visa.
In this episode of The Immigration Conversation, Partner Lunga Mani and Director Johannes Kgotso Tiba discuss South Africa’s current immigration environment amid increased public and government attention on illegal migration, border management and immigration compliance. They explain how immigration supports the country’s efforts to attract skills and contribute to economic development, while emphasising the importance of maintaining lawful status.
The conversation explores the visa options available to individuals seeking to live or work in South Africa, as well as the limitations on changing immigration status from within the country. Lunga and Johannes discuss why individuals should apply for the visa that reflects the true purpose of their stay, noting that a visitor’s visa should not be used as a route to enter the country and later take up employment.
They also examine common compliance mistakes, including failing to check visa expiry dates, working outside the activities permitted by a visa and not identifying errors in visa documents or entry stamps. The speakers encourage foreign nationals to understand the conditions of their status, monitor important dates and raise any errors with the relevant authorities as early as possible.
For employers, the episode highlights the potential financial, operational and reputational consequences of employing someone without the correct work authorisation or allowing an employee to perform a role that does not align with the conditions of their visa. Noncompliance can result in fines and increased scrutiny for employers, while foreign nationals may face the loss of employment, deportation and difficulties with future visa applications.
