New Coronavirus-Related Rule Requires Employers to Submit Report Regarding Chinese Employees

The situation
New instructions on Indonesia’s Ministry of Manpower’s (MOM) website require employers with Mainland Chinese employees to submit an online report to the MOM.
A closer look
The information in the report must include:
- a list of active foreign employees and their country of origin;
- a list of foreign employees with active Indonesia stay permits who are currently abroad and are unable to return to the country due to coronavirus-related flight restrictions;
- a list of foreign employees from Mainland China under a Short Term Permit whose permit has expired and who are unable to return to their home country; and
- a description of the employer’s efforts to prevent the spread of coronavirus within the company.
Employers must continuously report updated information when they hire Mainland Chinese employees until further notice.
Impact
Although there are no known deadlines or penalties for noncompliance at the time of the publication of this alert, employers should establish internal mechanisms to be able to accurately report this information. Fragomen can assist with this process.
Background
- Similar reporting requirements. Vietnam recently implemented a similar reporting requirement under which employers with Mainland Chinese nationals or foreign nationals who have traveled to Mainland China (and/or other countries affected by the coronavirus) must provide a list of foreign employees to authorities.
- Coronavirus measures. The outbreak of the novel coronavirus (COVID-19) has been declared a public health emergency by the World Health Organization.
