A new $100,000 fee on certain H-1B visas could affect U.S. employers recruiting skilled international professionals, including in the medical field. In an article published in Post Bulletin, Partner Bo Cooper explains that the fee applies only to new petitions filed on or after September 21, 2025, and does not impact existing H-1B holders or extensions with the same employer.
Bo also notes that the proclamation may allow for exemptions when the Department of Homeland Security determines that a role is in the U.S. national interest. He adds that it is still unclear which positions might qualify, though this could potentially include roles in health care, research, or other critical sectors where global talent supports public health or essential services.
