After a court order, the U.S. Citizenship and Immigration Services (USCIS) has announced it is dropping its government filing fee increases for the EB-5 Immigrant Investor Visa Program.
In 2024, USCIS EB-5 filing fees, among many other nonimmigrant and immigrant filing fees, were sharply increased. Last week, a judge of the Northern District of Colorado ruled that USCIS improperly raised fees on EB-5 petitions for both investors and EB-5 regional centers, which were among the steepest fee increases in 2024.
The Colorado judge found that the 2024 fee increases violated the Administrative Procedure Act and the EB-5 Reform and Integrity Act. As a result, USCIS announced, effectively immediately, that it will reduce government filing fees back to the original amounts before the fee increases (please see below for the new fee chart).
This development is positive for EB-5 investors—both new applicants and those already in process—who benefit from continued expedited case processing and reduced government fees. Although future fee increases are expected, the restored lower fees mark an opportune time to submit EB-5 applications.
