Da grenzüberschreitende Tätigkeiten innerhalb Europas kontinuierlich zunehmen, entsenden Arbeitgeber ihre Mitarbeitenden häufig zu kurzen Geschäftsreisen, Projektaufenthalten oder befristeten Einsätzen ins Ausland. In diesen Fällen gelten die sozialversicherungsrechtlichen Vorschriften weiter und die A1-Bescheinigung ist das zentrale Dokument, um zu bestätigen, welches Sozialversicherungssystem während der Tätigkeit im Ausland zuständig bleibt.

Was ist die A1-Bescheinigung?

Die A1-Bescheinigung bestätigt, dass die beschäftigte Person trotz vorübergehender Tätigkeit im Ausland weiterhin dem deutschen Sozialversicherungsrecht unterliegt. Dadurch wird vermieden, dass für denselben Zeitraum Sozialversicherungsbeiträge im Ausland entrichtet werden müssen.

Die Bescheinigung wird grundsätzlich benötigt, wenn Mitarbeitende vorübergehend in einen Mitgliedstaat der Europäischen Union (EU), einen Staat des Europäischen Wirtschaftsraums (EWR) oder die Schweiz entsandt werden. Dies kann sowohl bei längeren Entsendungen als auch bei kurzfristigen Dienst- oder Geschäftsreisen relevant sein.

Wann muss ein Arbeitgeber eine A1-Bescheinigung beantragen?

Arbeitgeber sollten eine A1-Bescheinigung beantragen, wenn Mitarbeiter eines in Deutschland ansässigen Unternehmens vorübergehend im europäischen Ausland tätig werden und dabei weiterhin dem deutschen Sozialversicherungsrecht unterliegen.

Typische Beispiele sind:

      • Geschäftsreisen
      • Projektaufenthalte im Ausland
      • Installations – und Montageeinsätze
      • Vorübergehende Entsendungen zu Kunden oder verbundenen Unternehmen
      • Tätigkeiten von bis zu 24 Monaten im Ausland

Grundsätzlich sollte der Antrag vor Beginn der Reise gestellt werden. So können Mitarbeiter gegenüber ausländischen Behörden nachweisen, dass weiterhin deutsches Sozialversicherungsrecht Anwendung findet.

Bei kurzfristigen anberaumten oder spontanen Dienstreisen kann die Bescheinigung unter Umständen auch nachträglich ausgestellt werden. In solchen Fällen empfiehlt es sich, die Antragsbestätigung mitzuführen, die in der Regel kurz nach der elektronischen Antragstellung verfügbar ist.

Für Mitarbeitende, die regelmäßig innerhalb der EU unterwegs sind – beispielsweise wöchentlich oder mindestens fünfmal pro Quartal –, kann eine sogenannte A1-Dauerbescheinigung beantragt werden. Dadurch lässt sich der administrative Aufwand für häufige Geschäftsreisen erheblich reduzieren.

Praxistipp: Die A1-Pflicht sollte auch bei kurzen Geschäftsreisen nicht unterschätzt werden. Da in vielen europäischen Staaten entsprechende Kontrollen durchgeführt werden, empfiehlt sich eine frühzeitige Beantragung, um Verzögerungen und Nachfragen zu vermeiden.

Welche Voraussetzungen müssen erfüllt sein?

Damit eine A1-Bescheinigung ausgestellt werden kann, müssen insbesondere folgende Voraussetzungen vorliegen:

      • Die Beschäftigung unterliegt deutschem Sozialversicherungsrecht.
      • Die Entsendung darf eine Höchstdauer von 24 Monaten nicht überschreiten.
      • Die entsandte Person ersetzt keine zuvor auf derselben Position eingesetzte entsandte Person ersetzen.

Wie erfolgt die Antragstellung?

Anträge auf Ausstellung einer A1-Bescheinigung müssen elektronisch über das SV-Meldeportal der deutschen Sozialversicherung eingereicht werden.

Alternativ kann die Antragstellung über die im Unternehmen eingesetzte Lohn- und Gehaltsabrechnungssoftware erfolgen. Arbeitgeber können den Antrag selbst stellen oder  externe Dienstleister, beispielweise Rechtsanwaltskanzleien, damit beauftragen.

Nach Übermittlung des Antrags wird eine elektronische Antragsbestätigung ausgestellt. Diese kann genutzt werden, falls die eigentliche A1-Bescheinigung vor Reiseantritt noch nicht vorliegt.

Wie lange dauert die Bearbeitung?

Die elektronische Bestätigung der Antragstellung wird in der Regel innerhalb von etwa 15 Minuten bereitgestellt. Die eigentliche A1-Bescheinigung wird – abhängig vom Einzelfall – innerhalb weniger Stunden bis zu mehreren Tagen elektronisch übermittelt.

Warum sollten Arbeitgeber den Antrag nicht unterschätzen?

In vielen europäischen Ländern führen Behörden Kontrollen durch und können Nachweise über den sozialversicherungsrechtlichen Status entsandter Mitarbeiter verlangen. Kann die A1-Bescheinigung nicht vorgelegt werden, drohen Verzögerungen, Nachfragen oder zusätzliche administrative Aufwände.

Aus diesem Grund wird Arbeitgebersn dringend empfohlen, das A1-Antragsverfahren frühzeitig in die internen Prozesse für Geschäftsreisen und Entsendungen zu integrieren.

Fazit

Für Arbeitgeber mit in Deutschland beschäftigten Mitarbeitenden ist die A1-Bescheinigung inzwischen eine Standardanforderung bei grenzüberschreitenden Einsätzen innerhalb Europas. Ob kurze Geschäftsreise oder mehrmonatige Entsendung – die A1-Bescheinigung bestätigt den Fortbestand des deutschen Sozialversicherungsschutzes und hilft, Komplikationen während des Auslandseinsatzes zu vermeiden.

Eine sorgfältige Planung und rechtzeitige Antragstellung tragen wesentlich dazu bei, Compliance-Risiken zu minimieren und unnötige bürokratische Belastungen zu vermeiden.

A1 Certificate for Business Trips and Assignments: What Employers Need to Know

As cross-border work within Europe continues to rise, employers frequently send staff on short business trips, project assignments and temporary postings abroad. In these cases, social security rules still apply and an A1 certificate is the key document confirming which country’s system remains responsible during the period of work abroad.

What Is an A1 Certificate?

An A1 certificate confirms that an employee remains covered by German social security law despite temporarily working in another country. This prevents the need to pay social security contributions in the host country for the same period.

The certificate is generally required when employees are temporarily posted to another European Union (EU) Member State, countries within the European Economic Area (EEA) or Switzerland. It may be required for both long-term assignments and short-term business trips or work-related travel.

When Must an Employer Apply for an A1 Certificate?

Employers should apply for an A1 certificate whenever employees of a company based in Germany temporarily work in another European country while remaining subject to German social security legislation.

Typical examples include:

      • Business trips
      • Project-based stays abroad
      • Installation and assembly work
      • Temporary assignment to customers or affiliated companies
      • Assignments abroad for up to 24 months

As a general rule, employers should submit the application before the employee begins travelling. This allows employees to demonstrate to foreign authorities, if required, that German social security legislation continues to apply.

In the case of short-notice or spontaneous business trips, the certificate may sometimes be issued retrospectively. In such cases, it is advisable to carry the application confirmation, which is generally made available shortly after the electronic application has been submitted.

For employees who regularly travel within the EU—for example, on a weekly basis or at least five times per quarter—a long-term A1 certificate (A1 Dauerbescheinigung) may be requested. This can significantly reduce the administrative burden associated with frequent business travel.

Practical Tip: The A1 requirement should not be underestimated, even for short business trips. Since inspections are conducted in many European countries, submitting the application early is recommended to avoid delays and queries from authorities.

What Requirements Must Be Met?

To obtain an A1 certificate, the following key requirements must generally be satisfied:

      • The employment relationship must be subject to German social security legislation.
      • The secondment must be limited to a maximum period of 24 months.
      • The posted employee must not replace another employee who was previously posted to the same position.

How Is the Application Submitted?

Applications for an A1 certificate must be submitted electronically via the German Social Security Reporting Portal (SV-Meldeportal).

Alternatively, employers can apply through their existing payroll or remuneration software. Employers may submit applications themselves or instruct external service providers, such as law firms, to do so on their behalf.

Once the application has been submitted, an electronic confirmation of submission is issued. This confirmation can be used if the employee needs to travel before the final certificate has been received. 

How Long Does Processing Take?

Electronic confirmation of submission is generally provided within approximately 15 minutes.

The A1 certificate itself is usually issued electronically within a few hours to several days, depending on the specific circumstances of the case.

Why Should Employers Not Underestimate the Application Process?

Authorities in many European countries conduct inspections and may request proof of the posted employee’s social security status. If an A1 certificate cannot be presented when required, employers and employees may face delays, additional enquiries or other administrative complications.

For this reason, employers are strongly advised to integrate the A1 application process into their company’s travel and secondment procedures at an early stage.
