New Notification and Document Retention Requirement for Foreign Employers Seconding Employees

Foreign employers seconding employees to Bulgaria must comply with new notification and document retention rules by February 10, 2017.
Notification Rule Details
Foreign employers seconding employees to Bulgaria must file a form with the Labor Inspectorate by February 10, 2017. The foreign employer may authorize the Bulgarian host entity to file the form on its behalf through a representative employee.
Document Retention Rule Details
Additionally, the Bulgarian company must maintain the following documents related to the employee’s posting during the assignment and for one year following the end of the assignment (in hardcopy or electronic form and translated in Bulgarian):
- Proof of the employment relationship between the posted employee and the foreign entity;
- Time sheets; and
- Pay slips.
Background
The new rules finalize the ongoing reform to align Bulgarian legislation with the EU Directive rules regarding notifications for seconded employees.
