Um die Integration von Nicht-EU/EFTA-Staatsangehörigen zu erleichtern, die sich länger in der Schweiz aufhalten wollen, hat die Schweizer Regierung im Januar 2019 eine Pflicht zur Vorlage eines Sprachzertifikats oder einer Anmeldebestätigung für einen kantonalen Sprachkurs eingeführt. Diese Regelung soll für Ehepartner oder andere Angehörige von Nicht-EU/EFTA-Staatsangehörigen über 18 Jahren gelten, die einen Nicht-EU/EFTA-Staatsangehörigen mit einer Niederlassungsbewilligung (Ausweis C) oder einer Aufenthaltsbewilligung (Ausweis B) begleiten. Das Hauptziel ist, dass sich diese Personen in der gesprochenen Sprache des Aufenthaltsortes (Deutsch, Französisch oder Italienisch) verständigen können.

Unsere praktische Erfahrung zeigt, dass ausländische Staatsangehörige immer noch Schwierigkeiten haben, diese Anforderung zu erfüllen. In diesem Blog geben wir daher weitere Einblicke und teilen unsere Erfahrungen aus der Praxis mit dem Erfordernis eines Sprachzertifikats für die Schweizer Einwanderung. Der Schwerpunkt liegt dabei auf Ehepartnern von Nicht-EU/EFTA-Staatsangehörigen sowie auf Angehörigen über 18 Jahren eines Inhabers einer B- oder C-Bewilligung aus einem Nicht-EU-Staat.

Hintergrund der neuen Integrationsvorschriften

Die Anforderung besagt, dass die kantonale Sprachkompetenz mindestens auf dem Referenzniveau A1 liegen muss. Während der Übergangs- und Umsetzungsphase im Jahr 2019 akzeptierten die Behörden alle Sprachzertifikate oder Anmeldebestätigungen, auch wenn die Sprachschule oder das Sprachzertifikat nicht zertifiziert war. Ab dem 1. Januar 2020 muss das Sprachzertifikat jedoch von einer zertifizierten und anerkannten Sprachschule ausgestellt worden sein, die international anerkannte Qualitätsstandards erfüllt. Dementsprechend werden ab diesem Datum nur noch Sprachzertifikate akzeptiert, die von einem von der Konföderation anerkannten Anbieter (Staatssekretariat für Migration, kurz: SEM) ausgestellt wurden. Was dies in der Praxis bedeutet

Personen mit Nicht-EU/EFTA-Staatsangehörigkeit, die bereits im Besitz einer B- oder C-Bewilligung sind oder sich im Verfahren zur Erlangung einer B-Bewilligung befinden und ihre Familienangehörigen in die Schweiz holen möchten, müssen in der Regel einen Antrag auf Familiennachzug stellen. Für mitreisende Familienangehörige, die nicht die EU-/EFTA-Staatsangehörigkeit besitzen, ist neben den üblichen Unterlagen entweder ein Sprachzertifikat (aus der Liste der akzeptierten Zertifikate) oder eine Anmeldebestätigung vorzulegen, aus der hervorgeht, dass der Ehepartner oder andere unterhaltsberechtigte Personen über 18 Jahre bei ihrer Ankunft in der Schweiz einen Sprachkurs besuchen werden, um einen anerkannten Sprachtest auf A1-Niveau zu absolvieren. Ehepartner oder andere Familienangehörige über 18 Jahre eines Inhabers einer B- oder C-Bewilligung aus einem Nicht-EU-Land, die sich bereits in der Schweiz aufhalten, müssen spätestens bei der Erneuerung ihrer Bewilligung den aktuellen Sprachnachweis vorlegen (zur Erinnerung: B-Bewilligungen für Nicht-EU-Bürger werden mit einer Gültigkeit von einem Jahr ausgestellt).

Auf welche Herausforderungen stossen die Menschen?

Ausnahmeregelungen

Auf den Sprachnachweis kann verzichtet werden, wenn:

  • die offizielle kantonale Sprache, gesprochen am Wohnort, die Muttersprache des Ehepartners ist;
  • mindestens 3 Jahre am verpflichtenden Unterricht in einer der offiziellen Schweizer Sprachen teilgenommen wurde;
  • die Ausbildung auf der Sekundarstufe II (z.B. Lehre, Gymnasium oder Fachhochschule) oder auf der Tertiärstufe (z.B. Universität, Hochschule oder Fachhochschule) in der kantonalen Amtssprache abgeschlossen wurde;
  • der/die Ehepartner/-partnerin einen medizinischen Nachweis über eingeschränkte kognitive Fähigkeiten erbringen kann.
