
Effective January 1, 2025, the Latvian government has added additional requirements for employers publishing job vacancies. Specifically, employers must provide an explanation (such as employee rotation, newly created positions, or employee departure, among others) for the number of job vacancies they submit through the State Employment Agency’s portal. Further, if the State Employment Agency suggests a job seeker from its database, the employer must provide a rationale for any candidate they reject within 10 business days.
Additionally, if the State Employment Agency determines that a candidate was rejected for an invalid reason, they will now issue an opinion, although details on what the opinion contains are not yet available. Employers are able to appeal this decision, initially to the Director of the State Employment Agency, or if denied, in court. As before, employers must publish the job vacancy on the State Employment Agency’s portal for 10 business days before submitting the job offer. These new rules are being implemented to protect and limit the hiring of foreign nationals by employers who intend to deploy them to other EU Member States, leading to situations where these employees are fired or leave their jobs and become undocumented immigrants.
