Recientemente, Migración Colombia emitió la Resolución 3167 de 2019 que establece importantes cambios en relación con los tipos de permiso de ingreso y permanencia en Colombia. Los cambios entran en vigor el 01 de diciembre de 2019. A continuación, compartimos algunos de las principales modificaciones que esta Resolución establece. Los permisos de ingreso y permanencia están clasificados en tres (3) categorías y continuara siendo aplicables para aquellas nacionalidades no restringidas o siendo restringidas cuentan con algún tipo de excepción. Es importante recordar que estos permisos son otorgados exclusivamente para aquellos extranjeros sin la intención de permanencia en Colombia y que desarrollen actividades sin animo de lucro; en caso contrario se deberá tramitar la visa aplicable al caso.

Así las cosas, Migración Colombia reagrupa los antiguos PIP en tres grandes categorías: (i) Permiso de Turismo (PT); (ii) Permiso de Integración y Desarrollo (PID); y (iii) Permiso para Otras Actividades (POA). El termino de permanencia dependerá de cada permiso y actividades a desarrollar por el extranjero, no obstante, la permanencia del extranjero en el país no podrá exceder de 180 días calendario por año calendario. En este sentido, a continuación, detallamos cada uno de estos:

  • El Permiso de Turismo (PT); es el nuevo permiso de turismo que a su vez permite a los extranjeros desarrollar actividades tales como tratamientos médicos, asistencia a eventos culturales, científicos, deportivos, convenciones o para negocios.  
  • El Permiso de Integración y Desarrollo (PID): será otorgado a aquellos extranjeros que pretendan ingresar al país desarrollar alguna de las siguientes actividades: en desarrollo y cumplimiento de Convenios, Acuerdos o tratados de cooperación y asistencia internacional. Adicionalmente, se otorgará para asistir en calidad de estudiantes, en desarrollo de programas académicos no formales o practicas estudiantiles, o en virtud de un convenio académicos de intercambio o para ser entrenado en un arte u oficio, cuya duración sea inferior a ciento ochenta (180) días, entre otro tipo de actividades.
  • El Permiso para Otras Actividades (POA): será otorgado a aquellos extranjeros que requieran ingresar al país de manera urgente a brindar asistencia técnica especializada que no pueda ser obtenida en el país, a realizar presentaciones artísticas en giras o eventos masivos, entre otros. 
 
Importante mencionar que Migración Colombia señala expresamente que aleatoriamente la autoridad migratoria podrá solicitar la presentación de los soportes documentales físicos o digitales que demuestren o acrediten la actividad a desarrollar por el extranjero como por ejemplo carta de invitación, hospedaje, tiquete de regreso, solvencia económica entre otros.
 

Adicionalmente, se hace referencia al ingreso a Colombia por parte de los nacionales y residentes de los siguientes países de la CAN y Mercosur (Argentina, Bolivia, Brasil, Chile, Colombia, Ecuador, Paraguay, Perú y Uruguay) flexibilizando así las alternativas para su ingreso. En este sentido, Migración Colombia ha determinado expresamente cuales son los documentos de viaje admitidos para estos efectos, tales como pasaporte o documento nacional de identidad, entre otros, y una vez admitido el ingreso del extranjero al país se le otorgará una Tarjeta Migratoria Electrónica.

 

De igual forma, se indica que se admitirá el ingreso de nacionales venezolanos al país con su documento de identidad nacional acompañado de la tarjeta migratoria ante circunstancia de fuerza mayor o urgencia, esto a pesar de que Venezuela se encuentre suspendido del acuerdo Mercosur.  

 

Por otro lado, esta resolución establece y autoriza el ingreso a los ciudadanos extranjeros nacionales de países a los cuales Colombia exige visa (nacionalidades restringidas), siempre y cuando tengan un permiso o residencia permanente de estados miembro de la Alianza del Pacífico (México, Chile y Perú).

 
Por último, otra de las medidas a resaltar que se incluyen en la mencionada resolución, tiene que ver con los cobros por concepto de reciprocidad que se harán efectivos durante el proceso de control migratorio en los puestos de control de Migración Colombia. De igual forma, se resalta expresamente el pago por reciprocidad para los nacionales de Nicaragua que pretendan ingresar a Colombia.

Así las cosas, esta resolución evidencia los esfuerzos del gobierno por atender las necesidades de un proceso migratorio expedito, fácil y flexible con el fin de adecuar el ordenamiento jurídico colombiano a las tendencias y realidades de la región.
