If your employee's residence permit has expired and the immigration office has yet to issue a new one, it is essential to understand their legal standing. If your employee submitted an application for an extension before their permit expired, they retain valid legal status, a concept known as the “interim effect.” This allows your employee to continue working and residing in Germany during this period. Additionally, the immigration office can issue an interim permit, which is necessary if your employee plans to travel abroad.
Senior Associate Isabel Schnitzler discusses the interim effect and how to obtain the permit in this Mobility Minute. Please also refer to Isabel’s blog on this topic for additional insights: Considerations Surrounding Germany’s “Interim Permit.
