United States: TPS Employment Authorization Again Extended Briefly for Several Countries

The issue
U.S. Citizenship and Immigration Services (USCIS) is continuing to briefly extend the validity of employment authorization documents (EADs) issued under the Temporary Protected Status (TPS) designations for Burma (Myanmar), Ethiopia, Haiti, Somalia, South Sudan, Syria, and Yemen. The TPS EADs for all of the countries except Haiti will be extended through July 17, 2026; Haiti TPS EADs will be extended through July 24, 2026. The previous extension of EAD validity for these countries was set to expire today.
USCIS continues to briefly extend TPS EADs for the above countries following the June 25 U.S. Supreme Court ruling that the Trump Administration could proceed with its plan to terminate the TPS designations for Haiti and Syria. The Supreme Court decision is anticipated to affect the outcome of all ongoing TPS litigation, including for the remaining above countries. Those district court cases are:
- Aung DOE et al. v. Noem et al., No. 25-cv-15483 (N.D. Ill.) (Burma (Myanmar));
- African Communities Together et al. v. Noem et al., No. 26-cv-10278-BEM (D. Mass.) (Ethiopia);
- African Communities Together et al. v. Noem et al., No. 26-cv-11201 (D. Mass.) (Somalia);
- African Communities Together et al. v. Noem et al., No. 25-cv-13939-PBS (D. Mass.) (South Sudan); and
- Doe v. Noem et al., No. 26-cv-2103 (S.D.N.Y.) and Doe v Noem et al., 26-cv-2280 (S.D.N.Y.) (Yemen).
Which EADs are affected by the extension?
USCIS is extending Haiti TPS EADs through July 24, 2026 if the EAD has an original expiration date of Feb. 3, 2026, Aug. 3, 2025, Aug. 3, 2024, June 30, 2024, Feb. 3, 2023, Dec. 31, 2022, Oct. 4, 2021, Jan. 4, 2021, Jan. 2, 2020, July 22, 2019, Jan. 22, 2018, or July 22, 2017.
The following is a list of TPS EADs that benefit from today’s automatic extension through July 17, 2026.
Burma (Myanmar): TPS EADs with an original expiration date of Nov. 25, 2025, May 25, 2024, or Nov. 25, 2022.
Ethiopia: TPS EADs with an original expiration date of June 12, 2024, and Dec. 12, 2025.
Somalia: TPS EADs with an original expiration date of March 17, 2023, September 17, 2024, or March 17, 2026.
South Sudan: TPS EADs with an original expiration date of Nov. 3, 2023, May 3, 2025, or Nov. 3, 2025.
Syria: TPS EADs with an original expiration date of Sept. 30, 2025, March 31, 2024, Sept. 30, 2022, or March 31, 2021
Yemen: TPS EADs with an original expiration date of March 3, 2023, Sept. 3, 2024, or March 3, 2026.
