Poland’s major immigration law reform, which came into force in mid-2025, is now being fully implemented through a series of significant regulatory changes. Some provisions have already been in effect since 1 December 2025, while others are expected to come into force in early 2026. In parallel with the changes implementing the major reform, other legal developments continue to take place – easy to miss, but equally important.

Key Changes Implementing Poland’s Immigration Law Reform:

  • New fees for work permit and special permission applications – effective 1 December 2025 
  • New regulation on supporting documents required for Work Permit and Special Permission applications – effective 1 December 2025 
  • Updated list of work permit exemptions – effective 1 December 2025 
  • Revised list of countries eligible for employment based on special permission (Georgia removed) – effective 1 December 2025 
  • New mandatory forms for residence permit applications – effective 1 December 2025 
  • Full electronic submission of residence permit applications via the MOS system and further revision of the mandatory forms for residence permit applications – expected January 2026 

Other Important Changes to Poland’s Immigration Law

  • Start of gradual adoption of the Entry/Exit System (EES) and changes to visa-free entry to Poland for nationals of countries with bilateral visa-waiver agreements – effective 12 October 2025 
  • New minimum salary threshold for employees posted to Poland from abroad – effective 19 November 2025 
  • Increased visa application fees – effective 1 January 2026 
  • Mandatory personal appearance for foreigners applying for a PESEL number – effective 1 January 2026 
  • New CUKR residence cards for Ukrainian nationals intending to remain in Poland after the discontinuation of temporary protection regime – expected   January 2026
