1. DHS、非移民に対する裁量的な最長60日間のグレースピリオド廃止を提案

要点

・本提案では、雇用が終了したE-1、E-2、E-3、H-1B、H-1B1、L-1、O-1およびTNの非移民ならびにその扶養家族に現在認められている、裁量的な最長60日間のグレースピリオドを廃止します。

・DHSは、9月11日の正式公示後60日間、パブリックコメントを受け付けます。本規則は、コメントを検討し、施行日を定めた最終規則を公布するまで発効しません。

 

概要

国土安全保障省(DHS)は、E-1、E-2、E-3、H-1B、H-1B1、L-1、O-1およびTNの非移民本人ならびにその扶養家族について、本人の許可滞在期間が満了する前に雇用が終了した場合に現在利用可能な、裁量的な最長60日間のグレースピリオドを廃止する規則案を提示しています。本提案はFederal Registerに掲載され、60日間のパブリックコメント期間が設けられます。連邦規則制定手続を完了するまで最終化されません。

DHSによれば、本提案はグレースピリオドの運用に伴う行政負担を軽減することを目的としています。

背景

裁量的な最長60日間のグレースピリオドは、2016年の規則により創設され、2017年初頭に発効しました。この規則に基づきグレースピリオドを認められた対象非移民およびその扶養家族は、本人の雇用が終了したことのみを理由として非移民資格を維持できなかったとはみなされません。最長期間は、60日間または本人のI-94有効期限までのいずれか短い期間で、各承認済み請願の有効期間中に1回利用できます。

グレースピリオドは、失職による移民法上の不利益を緩和するために設けられました。対象者は、米国を出国することなく同一カテゴリーで別の雇用を探すこと、在留資格を変更すること、または出国準備を行うことができます。雇用終了が自発的か非自発的かを問わず適用されます。

本提案の意味と今後の見通し

本規則が最終化された場合、許可滞在期間の満了前に雇用が終了した非移民は、別途米国に滞在する権限を有しない限り、直ちに米国を出国する必要があります。DHSは、一部の外国人に対して、退去強制手続の開始に向けた政府の第一段階である出頭通知(NTA)が発付され得ることを認めています。H-1B、O-1およびPなど、雇用終了時に雇用主が政府へ直ちに通知するカテゴリーでは、NTA発付の可能性がより高まることも考えられます。

本提案が雇用主または外国人に直ちに影響を及ぼすことはありません。DHSが受領した意見を検討し、具体的な施行日を定めた最終規則を公布するまで発効しません。

日系企業への影響:対象カテゴリーの駐在員・現地採用者が退職または解雇された場合、転職、資格変更または出国準備の時間が大幅に限定される可能性があります。日系企業は、雇用終了の決定前に人事、法務、モビリティ担当者および移民法専門家が連携し、本人・扶養家族のI-94、代替資格、出国手配、帰国費用、給与・福利厚生の終了時期を確認できる緊急対応手順を整備することが重要です。

2. 連邦地方裁判所、F・J・I非移民のD/S(資格継続期間)を廃止するDHS最終規則の施行を延期

要点

・マサチューセッツ州の連邦地方裁判所は、F、JおよびI非移民のD/Sによる入国許可を固定期間へ変更するDHS規則について、2026年9月15日に予定されていた発効日を一時的に延期しました。

・当面、DHSは最終規則の施行を禁じられ、F、JおよびI非移民には引き続きD/Sによる入国許可が適用されます。

・政府は裁判所判断に対し速やかに控訴する可能性があります。

 

概要

マサチューセッツ州の連邦地方裁判所は、F-1留学生、J-1交流訪問者、I報道関係者およびその扶養家族について、D/Sによる入国許可を固定期間の入国許可へ変更するDHS規則の発効日を延期しました。地方裁判所は、当面DHSによる規則実施の措置を禁じる仮差止命令を発令しました。政府は速やかに控訴すると見込まれます。

背景

多くの非移民が特定日までの滞在を許可される一方、F、JおよびI非移民は長年、教育・交流プログラムまたは対象となる雇用の継続期間について入国を許可されてきました。予定されていた規則では特定の滞在期間を設定し、追加期間が必要な場合には滞在延長を申請するか、米国を出国して再入国することが求められる予定でした。

同規則はF-1学生に対する新たな学業上の制限も設けています。教育団体および労働組合の連合は、同規則が行政手続法に違反し、恣意的かつ専断的でDHSの法定権限を超えるとして提訴しました。

今後の見通し

仮差止命令により、DHSは裁判所のさらなる命令があるまで最終規則を施行できません。ただし、雇用主および外国人は、命令が覆され、ほとんど、または全く事前通知なく規則が速やかに実施される可能性に備える必要があります。

日系企業への影響:当面はD/Sによる運用が継続するため、直ちに固定滞在期間を前提とした管理へ切り替える必要はありません。ただし、日系企業はF-1のOPT・STEM OPT人材、J-1研修生・交換訪問者、Iビザ該当者を特定し、I-94、プログラム終了日、就労許可期限を一元管理するとともに、規則が短期間で施行された場合の延長申請、海外出張および再入国への影響を確認する連絡体制を準備しておくことが望まれます。

3. DHSのOPT追加手数料に関する規則案、連邦審査を通過

要点

・行政管理予算局(OMB)は、F-1のOPT申請に追加手数料を課すDHS規則案の審査を完了しました。

・具体的内容は公表されるまで明らかになりませんが、OPT就労許可に関する追加手数料は高額となる可能性があります。

・規則案の公表後、30日間または60日間のパブリックコメント期間が設けられる見込みです。

 

概要

OMBは、最終化された場合にF-1のOPT就労許可申請へ追加手数料を課すDHS規則案について審査を完了しました。次の段階は、規則案をFederal Registerに掲載し、パブリックコメント期間を設けることです。手数料の詳細は掲載まで明らかになりませんが、新たな手数料は高額となる可能性があります。

日系企業への影響:追加手数料が導入された場合、F-1学生をOPTまたはSTEM OPTで採用する企業と候補者の費用負担が増加し、米国の大学を卒業する日本人留学生を含むF-1人材の採用判断や候補者の意思決定に影響する可能性があります。日系企業は、規則案公表後に手数料額、対象申請、施行日および経過措置を確認し、採用予算、費用負担方針、オファー時の説明について採用・人事・モビリティ部門間で統一することが重要です。

4. DOL、PERMプログラムの変更を提案へ

要点

・労働省(DOL)は、PERM労働市場テストその他の労働証明プログラムを改定する新規則の提案手続を開始しました。

・規則案はPERM募集活動の最低基準、米国人労働者の解雇に関する規則および雇用主の差別禁止規則を強化するものです。

・公表後、30日間または60日間のパブリックコメント期間が設けられます。

 

概要

DOLは、複数の雇用ベースのグリーンカード申請者および雇用主にとって第一段階となるPERM労働証明プログラムの各側面を改定する新規則について、提案手続を開始しました。規則案は現在OMBによる審査中です。

内容は公表まで非公開ですが、適格な米国人労働者の募集に関する最低基準を改定し、米国人労働者の解雇ならびに募集・採用における差別禁止要件への雇用主の遵守に関するPERM規則を強化することを目指しています。

PERM規則案の今後

規則案は連邦審査を通過後、Federal Registerに掲載され、パブリックコメント期間が設けられます。DOLが意見を検討し、具体的な施行日を定めた最終規則を公布するまで発効しません。

日系企業への影響:募集基準が厳格化された場合、雇用ベースの永住権手続に必要な期間、募集活動、証拠保全およびコストが増加する可能性があります。特にリストラクチャリングや人員削減を行う日系企業では、米国人労働者の解雇が既存・予定PERM案件へ及ぼす影響を早期に検討し、職務内容、最低要件、募集記録および候補者の不採用理由を一貫して文書化するため、人事・採用・法務部門の連携を強化することが望まれます。

5. 10月1日から、国務省がTN・TD・Iビザ申請者にオンライン上の活動歴審査を拡大

国務省の発表によれば、2026年10月1日から、在外米国領事館でビザを申請するTNおよびTD(USMCAに基づく専門職およびその扶養家族)ならびにI(外国報道機関関係者)の申請者は、ビザ申請の一環としてオンライン上の活動歴審査を受けます。対象には、ソーシャルメディアのアカウントおよび活動、オンラインデータベースやウェブサイト上の情報が含まれます。申請者は、国務省による審査を可能にするため、ソーシャルメディアのプライバシー設定を「公開」にする必要があります。

国務省の発表は審査基準の詳細を示していません。ただし、オンライン上の活動歴に政府が不利な情報と受け取る内容が含まれる場合、より広範なセキュリティ審査の対象となり、遅延の長期化やビザ拒否につながる可能性があります。オンライン上の活動歴審査は、E-1/E-2、F、M、J、H-1B、H-4その他の一定のビザカテゴリーについて既に実施されています。

日系企業への影響:カナダ・メキシコ国籍のTN専門職、その扶養家族およびIビザ申請者を雇用・派遣する日系企業は、2026年10月1日以降の申請予定者を早期に特定し、赴任・出張日程に審査遅延の余裕を持たせる必要があります。会社が特定の投稿の削除や変更を求めるのではなく、申請書、履歴書、会社ウェブサイトおよび公開プロフィールの事実関係に不整合がないかを本人と確認することが適切です。
