​Einreisebestimmungen und Ausnahmemöglichkeiten in Covid-Zeiten

Internationale Reisen, selbst wenn sie für bestimmte Arbeitszwecke erforderlich sind, sind angesichts der weltweit geltenden COVID-19-Beschränkungen zu einer echten Herausforderung geworden. Es gibt mehrere Hürden, darunter das Ausfüllen der vorgeschriebenen Papiere vor der Reise, die Anforderung den PCR-COVID-Test innerhalb bestimmter Fristen vor der Reise durchzuführen und ein negatives Testergebnis zur Vorlage bei der Ankunft bereitzuhalten, sowie die Registrierung nach der Einreise und Quarantänemassnahmen. Diese Anforderungen und Verpflichtungen ändern sich in rasantem Tempo und erfordern eine sorgfältige Planung für Geschäftsreisende, Personen, die aus beruflichen Gründen umziehen und deren Arbeitgeber.

Die Schweiz ist eines der Länder, die bei der Einreise die Vorlage eines negativen PCR-Testergebnisses verlangen. Sie hat auch strenge Quarantänebestimmungen, die nach der Einreise eingehalten werden müssen. Was viele jedoch noch nicht wissen, ist die seit wenigen Wochen geltende zusätzliche Meldepflicht, vor der Einreise ein Einreiseformular auszufüllen und einzureichen. Wird die Meldepflicht vor der Abreise nicht korrekt ausgefüllt, muss der Reisende damit rechnen, dass ihm die Einreise in die Schweiz verweigert wird. Alle Pflichten und Anforderungen, die für die Einreise in die Schweiz erfüllt werden müssen, hängen vom Ausreiseland, den Transitmodalitäten und dem Transportmittel in die Schweiz ab.

Die verschiedenen Konstellationen, die sich ergeben können, und die Aktualisierungen der Quarantänebestimmungen (die angesichts der dritten COVID-Welle in mehreren Ländern Kontinentaleuropas häufig vorkommen) machen die Reise in die Schweiz komplexer als viele darauf vorbereitet sind. Infolgedessen wurden wir in letzter Zeit um Beratung in Bezug auf eine beträchtliche Anzahl von "Notfall"-Szenarien gebeten, bei denen Anforderungen missverstanden wurden oder Unternehmen die neuesten von den Schweizer Behörden herausgegebenen Aktualisierungen nicht kannten.

COVID-19 Einreisebestimmungen: Ausnahmemöglichkeiten?

Was viele vielleicht nicht wissen, ist, dass die Schweiz bereit ist, unter bestimmten Umständen Ausnahmen von bestimmten COVID-19-basierten Einreisebestimmungen sowie Beschränkungen zu gewähren. Insbesondere bei der Einreise in die Schweiz für bestimmte Arbeits- oder Geschäftsreisetätigkeiten ist es möglich, von der Quarantänepflicht und unter bestimmten Umständen auch von der PCR-Testpflicht befreit zu werden. Unternehmen haben die Möglichkeit, für ihre Mitarbeiter vor Reiseantritt eine Befreiung von der Quarantäne- und PCR-Testpflicht zu beantragen. Die Bewilligung eines solchen Antrags kann für diejenigen, die zu wichtigen Arbeits- und Geschäftsreisezwecken in die Schweiz reisen, offensichtlich einen echten Unterschied machen.

Befreiungsanträge müssen in der Regel durch eine detaillierte schriftliche Eingabe unterstützt werden und werden den zuständigen kantonalen Behörden zur Prüfung vorgelegt. Es ist wichtig, Anträge vor der Reise zu stellen und genügend Zeit, idealerweise 1-2 Wochen, für die Prüfung und Entscheidung einzuplanen. Wenn sich nach der Einreise ein dringender Arbeitsbedarf ergibt, kann natürlich auch ein Antrag auf Befreiung im Land gestellt werden (um z.B. von der restlichen Quarantänezeit befreit zu werden).
