Enforcement of Compliance Requirements Increased for Employers of Non-EU Workers

Authorities have recently started enforcing the requirement for employers to not have been sanctioned by the Romanian Labour Authorities in the last three years for failing to register non-EU foreign employees.
Such registration, called the REVISAL, is due the day before the employee’s start date, at the latest.
Other Recently-Enforced Employer Requirements
Authorities are also enforcing the following requirements for employers hiring non-EU employees:
- The employer must perform the activity indicated in the corporate documents submitted with the foreign employee’s work permit application;
- The employer must be up to date with its state tax payments;
- The employer must not have been sentenced for Labour Code violations or intentional crimes; and
- The employer must not have exceeded the quota for foreign workers.
Employers that do not meet the above requirements may be barred from hiring non-EU employees.

Employers hiring non-EU nationals should be aware of the increased enforcement efforts, and should work with their administrative departments to ensure compliance with employee registration and other requirements.
