Hintergrund

2014 nahm das Schweizer Stimmvolk die Eidgenössische Volksinitiative «Gegen Masseneinwanderung!» an, welche zum Ziel hat, die Einwanderung in die Schweiz strenger zu regulieren. Seit dem 1. Juli 2018 werden im Rahmen der Umsetzung der Initiative arbeitssuchende Schweizer bei der Besetzung von Stellen vorrangig berücksichtigt.

Als Teil der Umsetzung der Initiative müssen Schweizer Arbeitgeber seit 1. Juli 2018 sämtliche offene Stellen in Berufsgattungen mit einer Arbeitslosigkeit von 8 Prozent oder mehr der öffentlichen Arbeitsvermittlung (öAV), bzw. den regionalen Arbeitsvermittlungszentren (RAV) melden. Die offenen Stellen dieser Branchen werden anschliessend für 5 Arbeitstage den Mitarbeitern der öAV und den bei der öAV als stellensuchend gemeldeten Personen angeboten, bevor sie für den gesamten Arbeitsmarkt ausgeschrieben werden dürfen. Während dieser Zeit werden von den RAV die Dossiers von geeigneten Personen für diese Stellen an die öAV weitergeleitet, welche diese dann prüfen und gegebenenfalls Bewerbungsgespräche einleiten.

Rückblick und Änderungen ab 1. Januar 2020

Ab dem 1. Januar 2020 wurde dieser Prozentsatz gesenkt: Es müssen nun offene Stellen von Berufsgattungen, die eine Arbeitslosigkeit von 5 Prozent oder mehr aufweisen, auf diesen Plattformen ausgeschrieben werden. Diese Änderung gibt Anlass für einen kurzen Rück- und Ausblick.

Im ersten Jahr seit der Einführung der Stellenmeldepflicht im Juli 2018 wurden insgesamt 200'000 Stellen bei der öAV gemeldet, von denen fast 100% innerhalb eines Tages geprüft und ausgeschrieben wurden. Die RAV waren in der Lage für mehr als die Hälfte der ausgeschriebenen Stellen mindestens einen geeigneten Kandidaten vorzuschlagen. Die Arbeitgeber stellten acht Prozent der Kandidaten, die von den öAV’s vorgeschlagen wurden, ein. Die Schweizer Regierung kann somit eine positive Bilanz vorweisen: Die stete Zunahme gemeldeter Stellen, die rasche Bearbeitung durch die Meldestelle, sowie die konsistenten Vermittlungen der RAV sind Nachweise der Akzeptanz und konsequenten Umsetzung der Stellenmeldepflicht.

Der Bewertungszeitraum für die Stellenmeldepflicht im Jahr 2020 bildet der Zeitraum Oktober 2018 – September 2019, in dem die Arbeitslosenquote gesamtschweizerisch bei durchschnittlich 2.3 Prozent lag. Die Senkung des Prozentsatzes auf 5 Prozent erfolgt zeitgleich mit einem Wechsel der Berufsnomenklatur. Dieser Änderung sorgt für eine bessere Differenzierung zwischen sehr ähnlichen, jedoch verschieden gut qualifizierten Berufsgruppen –  Beispielsweise werden qualifizierte Köche ab 2020 nicht mehr der Stellenmeldepflicht unterliegen, während die Regel für Hilfsköche weiterhin besteht. Ähnliche Differenzierungen in anderen Branchen wie etwa dem Bauwesen und Marketing werden gleichartige Folgen haben.
