With technological developments and progress all around us, digital transformation has become one of the driving forces behind the evolution of global immigration processes and policies worldwide.

What initially began as the implementation of online systems by governments following the COVID-19 pandemic has now matured into a permanent shift, reshaping the landscape of how countries approach immigration policy and regulate the movement of people.

In turn, this shift has also impacted the way companies operate their global mobility programs and has introduced new considerations around compliance and talent strategy.

Post-COVID-19 Shift: Government Adoption of Online Systems

The adoption of online systems by governments has revolutionized immigration procedures, leading to a prioritization of efficiency and accessibility. This shift has been positive for both companies and employees alike, eliminating the need for in-person requirements, such as registration at a local town hall, which were key during the pandemic.

It has also led to increased transparency in the application process. The adoption of technology has resulted in more streamlined, quicker processes, with a reduction in associated costs, time and less human error in completing applications.

Further, when authorities leverage technology, these jurisdictions become more business-friendly, and subsequently more attractive to companies attempting to recruit highly skilled talent. The more efficient and effective processes resulting from technological enhancements allow businesses to optimize their strategies while focusing on key goals and priorities—rather than spending time having to navigate clunky and antiquated immigration systems.

However, like any transformative change, the integration of online systems is not without its challenges. Technical glitches and user errors have been identified as “cons,” leading to delays in processing and potential complications.

Despite these hurdles, the benefits of enhanced accessibility and transparency have pushed governments towards leveraging more technology for global immigration matters.

Navigating Stricter Compliance in the Digital Age

As technology transforms immigration processes, a notable consequence is the heightened compliance environment impacting both employees and employers. The interconnectedness of tax, labor and immigration systems in certain jurisdictions has resulted in unintended impacts to immigration sponsorship. For example, if a company faces a labor fine in the Netherlands, it may be precluded from sponsoring employees because the labor and immigration databases are linked.  

This increased compliance culture is reshaping the mobility landscape, creating a more tightly regulated environment and increased accountability for employers. This interconnectedness highlights the importance of a comprehensive understanding of the regulatory landscape, necessitating a holistic approach to compliance.

In order to ensure a holistic approach to compliance, many companies are undergoing audits and leveraging technology themselves, such as Fragomen’s WorkRight™ technology, to ensure they are meeting their obligations. Talent Attraction and Retention in the Digital Age

This has profound implications for employers seeking to attract top talent globally.

Countries that offer flexibility, reliable internet infrastructure and efficient visa processing systems are emerging as key jurisdictions for employers. The ability to seamlessly navigate immigration processes allows for uninterrupted business operations, even in times of crisis or uncertainty.

The ability to offer remote work has become instrumental in accommodating the needs of the post-COVID-19 pandemic workforce. However, the flexibility offered by remote work has not gone unnoticed by governments. Some authorities are increasingly skeptical of growing remote workforces, leading to heightened inspections, audits and border inspections for employers, digital nomads and those entering for remote work.

Consideration for Employers

The impact of technology on global immigration following COVID-19 has been significant and continues to impact immigration policies and procedures worldwide, as well as talent and retention strategies.

It is critical that employers approach global immigration strategically and take compliance considerations seriously.

Understanding both the benefits and the risks of the increasingly interconnected compliance systems against a technology backdrop is key. The ability to navigate this increasingly digitized global immigration landscape will be the key to success for employers in the years to come.
