Willkommen bei unserer neuen Serie für den Mittelstand zum Thema Mitarbeiterentsendung und Compliance! In unserem ersten Artikel greifen wir die wichtigsten Punkte zur ICT-Karte auf und besprechen, wie der Mittelsand sie am besten nutzen kann.

Die ICT-Karte – Interessant für international aufgestellte Unternehmen

Die ICT-Karte ist eine Arbeits- und Aufenthaltserlaubnis für Fachkräfte aus Staaten außerhalb der EU. Dieser Aufenthaltstitel verspricht mehr Flexibilität beim konzerninternen Transfer von Mitarbeitern. Durch die ICT-Karte werden unternehmensinterne vorübergehende Transfers von Drittstaatsangehörigen (Spezialisten, Manager und Trainees) in einen Mitgliedstaat der Europäischen Union erleichtert. 

Die Branchen und Unternehmensbereiche, in denen eine solche Entsendung stattfinden soll, haben dabei keinen Einfluss auf die Erteilung einer ICT-Karte. Es kann sich um Projektarbeit beim Kunden in der IT-Industrie handeln genauso wie um die Mitarbeit an Forschungs- und Entwicklungsprojekten in der Automobilzuliefererbranche. Leiharbeit ist mit einer ICT-Karte hingegen nicht möglich.

Was setzt die ICT-Karte arbeitsrechtlich voraus?

Wichtig ist, dass es sich um eine unternehmensinterne Entsendung auf Grundlage eines weiterbestehenden ausländischem Arbeitsvertrags handelt. Wird der ausländische Arbeitsvertrag aufgelöst oder ruhend gestellt und ein neuer Vertrag im Inland begeben, so kommt eine Blaue Karte EU in Betracht.

Die ICT-Karte wird für längere Entsendungen genutzt

Die Maximaldauer der Entsendung beträgt drei Jahre, für Trainees ein Jahr. Danach kann die ICT-Karte nicht verlängert werden. Eine erneute Erteilung ist möglich, aber nur, wie bei der Ersterteilung auch, aus dem Ausland über ein Visumverfahren. Nach Beendigung des Aufenthalts muss zudem eine sog. Wartezeit von einem halben Jahr für die Neubeantragung eingehalten werden. Soll eine ausländische Fachkraft nach Ablauf der drei Jahre im Unternehmen in Deutschland weiterarbeiten, muss ihr ein lokaler Arbeitsvertrag angeboten werden. Dann kann der Person von der örtlichen Ausländerbehörde die Weiterarbeit ohne zwischenzeitliche Ausreise in Deutschland erlaubt werden.

Vereinfachte Verfahren bei Weiterentsendung innerhalb der EU

Wo früher meist ein zweiter, oft wochenlanger Arbeitsgenehmigungsprozess erforderlich war, reicht nun eine kurze Notifikation mit Grundangaben zur Weiterentsendung in eine Niederlassung in einem anderen EU-Mitgliedstaats aus, um dem Arbeitnehmer kurzfristigen Zugang zur Arbeit im selben Unternehmen zu ermöglichen. So kann etwa ein Computerspezialist, der, aus der Unternehmenstochter in Indien kommend, nun in der Niederlassung in Frankreich tätig ist, binnen kürzester Zeit auch in der Niederlassung in Deutschland eingesetzt werden.

Antragsstellung kann länger dauern

Arbeitgeber müssen bei der Beantragung einer ICT-Karte durch den Arbeitnehmer bei einer deutschen Auslandsvertretung die Bearbeitungs- und Wartezeiten berücksichtigen. Diese können schnell jeweils mehr als acht Wochen für die Terminwartezeit und die Bearbeitung ab Antragsstellung betragen. Außerdem müssen die Unternehmen oftmals eine Vielzahl von Dokumenten zusammenstellen, die oft wochenlange Vorbereitungsarbeiten mit sich bringen.  

Gehaltsbestimmungen

Das der entsandten Person gezahlte Gehalt muss dem für die Stelle in Deutschland angemessenen Gehalt entsprechen. In der Praxis kann bei Entsendungen aus Ländern mit niedrigerem Gehaltsniveau das zu zahlende Gehalt durch zweckungebundene Zulagen erreicht werden. ICT-Karteninhaber mit Familien dürfen diese für die Zeit des Aufenthalts nach Deutschland mitnehmen.
