At a glance

The Department of Homeland is extending Temporary Protected Status for Venezuela by 18 months, through March 10, 2024. Venezuelan TPS beneficiaries will be required to re-register to extend their benefits.

The issue

The Department of Homeland Security (DHS) has announced an 18-month extension of Temporary Protective Status (TPS) for Venezuela, which will be effective from September 10, 2022, through March 10, 2024. 

A closer look

  • Venezuela TPS beneficiaries will need to re-register to extend their status and work authorization. DHS is expected to announce the re-registration period and issue application instructions in the near future.
  • Only beneficiaries under Venezuelaโ€™s existing designation who were residing in the United States as of March 8, 2021, are eligible to re-register for TPS under this extension. Venezuelans who arrived in the United States after March 8, 2021, are not eligible for TPS. 
  • Venezuelans who are currently eligible for TPS under the existing designation but who have not yet applied for initial registration should file their applications prior to the September 9, 2022 application deadline, including those Venezuelans who are covered under the January 2021 grant of Deferred Enforced Departure (DED), which is set to expire on July 20, 2022. 

Looking ahead

The extension of TPS for Venezuela means that beneficiaries who submit a timely re-registration may continue to work and remain in the United States through March 10, 2024. Prior to the conclusion of the 18-month extension, the DHS Secretary will review conditions to again determine whether its TPS designation should be extended or terminated. Fragomen will provide an update when DHS announces the TPS re-registration period for Venezuela.
