
A new law requires foreign nationals to start working in Mozambique within 60 days of the issuance of their work visa and requires employers to pay a repatriation deposit on behalf of the foreign worker and his or her family. The new law also allows work visa holders to enter Mozambique multiple times until the end of their employment contract.
New Work Visa Application Process for Extraction Industry
Additionally, employers involved in extraction industry projects must now apply for work visas to the Mozambican Migration authorities. Such work visa applications will have to be accompanied by a work authorization granted by the Minister of Work after recommendation by the Minister of Mineral Affairs. The employer must also provide a guarantee equal to the repatriation costs for the employee and his or her family members.
In the event of cancellation of the work visa and termination of employment, the repatriation deposit will be returned as long as it is requested within 30 days of the date of foreign employee’s departure from the country.
What this Means for Employers
Employers must ensure that foreign workers under new work visas commence employment within 60 days of receiving their work visa. Furthermore, employers must keep records of repatriation deposits and ensure that any return requests are made within the required timeframe.
